ONE MORE COMPLAINT FOR MALICIOUS PROSECUTION AND DEFAMATION BY BAGLA FAMILY AGAINST KOTAK MAHINDRA BANK AND OTHERS INCLUDING UDAY S KOTAK AND ANAND MAHINDRA

After registration of an FIR for committing fraud and forgery by Kotak Mahindra Bank and others including Uday S. Kotak and Anand Mahindra, Bagla family has also filed a complaint with the Court of Chief Metropolitan Magistrate, New Delhi, under Section 200 r/w 190 Cr. P.C. for taking cognizance of offences Committed U/s 211 (IInd Part), 499/500, 501, 502 r/w 120B/34 IPC, against Kotak Mahindra Bank Ltd & others.

In the complaint apart from one Virendra Kumar Sharma, Kotak Mahindra Bank and its Directors & Company Secretary and other officers namely Mr. Uday Suresh Kotak, Managing Director, The Regional Manager, Kotak Bank (Delhi & NCR), Mr. Anand Mahindra, Mr. Shivaji Dam, Mr. Chengalath Jayram, Dipak Gupta, Ms. Bina Chandarana, Company Secretary, Mr. Chandra Shekhar Prasad (The Then Deputy Manager, Legal),  Mr. Sanjay Kumar, Officer, Kotak Bank and CVIL Infra Limited and Bennett Coleman & Company Ltd., were made accused.

It has been alleged in the complaint that the above named accused in connivance with the each other, falsely implicated one Bhupendra Bagla  son of Dr. Santosh Kumar Bagla (a renowned business family based at Mumbai & Delhi) in a criminal case by using forged and fabricated documents  created and used by the above named accused.

It has been further alleged in the complaint that the averments made by the accused in this regard has resulted in multiple litigations and publication, which are public documents and due to such malicious publication and false allegations, the reputation of complainant and Dr. Bagla’s family, got tarnished in the eyes of their friends, employees, business relations etc. It has been also alleged that the credibility built by the Complainant over a span of time, has been shattered due to leveling the false, frivolous, fictitious and baseless allegations against the complainant. The Court has been prayed to take cognizance of the matter and also prayed to punish the named accused as per law.

The matter was listed before the Court of Metropolitan Magistrate, Patiala House Courts, New Delhi wherein the Court has directed the complainant to file certified copies of the judicial record as relied upon and FIR lodged on the complaint of the accused, before the next date of hearing.

Elite Foundation’s Tree Plantation Drive Reaches Uttar Pradesh

Elite Foundation recently Gorakhpur to take forward its mission of planting 10 crore trees across India. Tree plantation activity was done at SNSS Academy, Betiahata in Gorakhpur city of Uttar Pradesh. At the event, Elite Foundation distributed T-shirt s as well as saplings amongst students of the school. On this special occasion students also filled up Shapath Patra and took pledge to make India green by planting trees and to pursue the dream project of Elite Foundation.

On this occasion the management team of the school and the officials of Elite Foundation received a warm welcome by the villagers who took part in the plantation activity. More than 5000 saplings were distributed and planted all over the rural area by campaigning door to door.

In this campaign National President of Elite Foundation, Mr. VK Agarwal said that the way pollution is increasing in the country today, Global Warming is increasing, water level is decreasing, forest are getting over and we the countrymen ignoring this dangerous situation,  that will have to bear a brunt of our future generations. So, all of us should join the mission of planting more and more trees and help Elite Foundation achieve their target of 10 crore trees.

The coordinator of the school Yomesh Nand Srivastava, Ruma Chakravarti, Jyoti Gupta, Rita Srivastava, Rina Srivastava, CP Singh, Pawan Banka, Ganesh Banka, Poonam Kanodia and Shilpi were present at the event and supported the program. It was indeed a successful effort by Elite Foundation.

     

After Gorakhpur, Elite Foundation and Jaipuram Design College, Sikar reached Harraiya, Basti district, Uttar Pradesh for tree plantation under its three-day program. This was followed by plantation in Kaptanganj, UP. Plantation was carried out at Sant Kabir Inter College, Maa Gayatri Inter College and Indira Gandhi Inter College by Shahnaz Jahan and his team Human Rights Conservation.

ग्वालियर शहर के प्रतिष्ठित व्यक्ति नीरज शर्मा (प्रार्थी) सुपुत्र श्री कैलाश शर्मा ने ग्वालियर निवासी उदयप्रताप शर्मा- कंपनी मेसर्स उदयप्रताप शर्मा (वर्तमान में भारती बिल्डकॉम ) पर करीब 4 करोड़ रुपये की ठगी करने का आरोप लगाया है ।

आरोप है कि  उदयप्रताप शर्मा ने प्रार्थी से लालपुर बांध के कार्य हेतु डीजल राशि 13,00,000 /- ( तेरह लाख )  डीलक्स मोटर्स (पेट्रोल पंप ) सनातन धर्म मंदिर के सामने इंदरगंज से लिया विनय शर्मा को 8,00,000 रुपये के सरिया भुगतान भी किया एवं अपनी एक मशीन भी कार्य करने हेतु दी जिसका भुगतान प्रार्थि की नही मिला , उदयप्रताप एक क्रेशर प्लांट भी लगाना था उसके लिए भी इन्होंने नीरज शर्मा यानी प्रार्थी से बीस लाख रुपये लिये जो वापिस भी नही किया ।

उदयप्रताप शर्मा ने प्रार्थी से हरसि हाई लेवल डबरा जिला ग्वालियर में दो टेंडर राशि 31 करोड़ एवं 18 करोड़ के निकले हैं उसके लिए नगद रुपये 25,00,000 (पच्चीस लाख) उसके मित्र के सामने लिया ,बाद उदयप्रताप शर्मा ने प्रार्थी को बताया कि कीन्ही वजह से टेंडर उनके हित मे नही हुआ और टेंडर के नाम से ली गयी धनराशि भी नही लौटाये । तरनोपरांत उदयप्रताप शर्मा ने प्रार्थी से व्यक्तिगत मिलकर कहा कि भाई एक बार फिर आप मेरी मदद कर दीजिए मेंने आपसे पहले जो पैसे लिए थे वो भी में लौटा दूंगा और फिर प्रार्थी जी लालच में आ गए कि उदयप्रताप जो पैसे मुझसे लिए थे वो अब मुझे मेरे पैसे अब लौटा देगें उदयप्रताप शर्मा को 3 करोड़ 78 लाख की इंडसाइंड बैंक में बैंक में बैंक गेरेँटर की बची हुई राशि1,99,62,272/- दिनांक 5-5-2011 को बैंक को पत्र जारी कर बैंक को नगदी करा दिया  ।

जैसे ही प्रार्थी को बैंक द्वारा सूचना दी गई तो प्रार्थी ने उदय प्रताप शर्मा से मिलके उनसे कहा कि धनराशि की व्यवस्था कर संबंधित बैंको में जमा कर दूंगा । दिनांक 26- 09 – 2011 को बैंक से कॉल आया कि संबंधित बैंक गारंटी में आप गारंटर हो और खाता क्रमांक 26- 09- 2011 को बैंक को आवेदन किया की मुझे डेढ़ करोड़ रुपये की क्रेडिट फैसिलिटी दी जाए जिससे में बैंक गारंटी का पैसा जमा कर सकू दिनांक 27- 09 2011 को बैंक ने आवेदन मंजूर करके मुझे डेढ़ करोड़ रुपये की क्रेडिट उपलब्ध करवाई उसके बाद मैंने जमा करने के लिए पैसे दिया जिसका दिनांक 27-09 2011 सेंगशन लेटर डेढ़ करोड़ है ।

उसके बाद प्रार्थी ने उदयप्रताप ने संपर्क किया कि मैने बैंक गारंटी का पैसा जमा कर दिया आप मेरा पैसा वापस कर दो ।

उदयप्रताप शर्मा ने कहा कि मेरे पास नगद पैसे नहीं है आप मेरी सम्पतियों की रजिस्ट्री करवा लो और अपना पैसा ले लो प्रार्थी ने उसी  समय  सिरोल मुरार ग्वालियर क्षेत्र में कई संपत्तियां दिखाई एक सपत्ती जो थाने वके बगल वाली भूमि का अन्यंत्र अनुबंध पत्र है लेकिन थाने के पीछे वाली भूमि जो है वह पाक साफ है ।

इस बात का आष्वासन उदयप्रताप शर्मा , भारती शर्मा अजय शर्मा इन तीनों ने प्रार्थी को दिया।

प्रार्थी को अपने दिए हुए पैसो की वसूली करनी थी इसलिए थाने के पीछे वाली भूमि की जो कि ग्राम सिरोल मुरार ग्वालियर की परिसीमा में आती है, वो 02 बीघा भूमि की थी सर्वे क्रमांक 116,12 मिन -2 12 मिन -2, उसका विक्रय पत्र  भारती शर्मा पत्नी उदय शर्मा से दिनांक 31- 03- 2016 को संपादित करवा लिया हैं उसके पूर्व भूस्वामी के प्रकरण न्यायालय में विचारधिन है । क्योंकि प्रार्थी ने भूमि पर जैसे ही कब्जा लेने हेतु कार्य किया उसी समय संबंधित न्यायालय से प्रार्थी के पास एक समय आया, प्रार्थी जब न्यायलय में उपस्थित हुआ तो ज्ञात हुआ कि प्रार्थी ने जो भूमि खरीदी हैं वह विवादित हैं । प्रार्थी पुनः इन तीनो लोगो से संपर्क किया तो उन्होंने कहा कि हमने तो आपको भूमि का विक्रय कर दिया हैं अब आप जानो या वो जाने , तब प्रार्थी ने पूर्व भूस्वामियों से न्यायालय में राजीनामा किया एवं तय धनराशी 21 लाख का नगद भुगतान किया और तब न्यायालय से राजीनामा हुआ।

उस समय उस विवादित भूमि के बगल से लगी भूमि सर्वे क्रमांक 115/02, उसके बारे में उदयप्रताप शर्मा ने बताया है  कि यह मेरे बेटे अजय शर्मा के नाम से हैं  लेकिन न्यायालय एवं सिविल न्यायालय में प्रकरण विचाराधीन है जैसे ही निपट जाएगा वैसे ही विक्रय पत्र आपके हित में संपादित कर देंगे अभी इसलिए नही हो सकता कि न्यायालय में विक्रय पत्र संपादित होने पर रोक लगी है इस भूमि के एवज में प्रार्थी से रुपए 15 लाख की बात तय हो गई जिसमें से इन्होंने कुछ रुपए 7,46,166  रेता के माध्यम से भी लिए प्रार्थी ने कई बार इनसे मिलकर जो धनराशि दी है उसकी मांग की है , लेकिन यह कहकर बार – बार टकराते रहे कि जैसे ही धनराशि की व्यवस्था हो जाएगी वैसे ही तुम्हारा हिसाब कर देंगे । विवादित भूमि के संबंध में हर आम खास संस्था , निकाय आदि को सूचित किया जाता है अन्य किसी भी प्रकार संव्यवहार  न करे ऐसा कोई भी संव्यवहार प्रार्थी के मुकाबले शून्य एवं निष्प्रभावी होगा तथा सव्यवहार करने वाला व्यक्ति स्वयं उत्तरदायी होगा।

Raju Mavani the Lion hearted actor filmmaker who launched Suniel Shetty in films with Balwaan passed away

Raju Mavani the Lion hearted actor filmmaker, who launched Suniel Shetty in film’s with Balwaan in 1992, passed away on Thursday 31st October 2019, at around 7.30 pm, due to Cancer. He was 62 years old.

Mavani was suffering from kidney ailments and was later diagnosed with cancer. He fought for three year’s before succumbing to the disease.

  

Apart from producing films like Ilaaka, Ramgarh Ke Sholey, Balwan and Imtihaan, with Mithun Chakraborty, Suniel Shetty, Sunny Deol, Saif Ali Khan, Aditya Pancholi, Raveena Tondon, late Divya Bharti, Monika Bedi, Divya Dutta & many other’s. Raju Mavani also directed film Suraksha, produced by his brother Nitin Navami. Raju also acted in several movies like Sarkar, Wanted, Shootout At Wadala and Policegiri to name a few.
